Terms of Service

Effective from 28.05.2026

§1. General provisions and definitions

These Terms govern the conclusion and performance of contracts for Additional Services purchased by Guests through the guest portal available at hostante.com (and at hostante.pl and hostante.eu) (the Portal) in connection with a stay at a property served by the Seller.

In short (for information, no legal force): you are purchasing Additional Services from the Seller — the operator of your apartment (trading as HeyRent). Hostante is the platform that presents the Seller's offer. You pay the Seller directly through the Seller's own Stripe account (a connected account managed by Stripe Technology Europe, Limited (STEL) — an Irish e-money institution supervised by the Central Bank of Ireland (ref. C187865)) — Hostante does not collect or hold your money. Hostante charges the Seller only a commission for providing the platform. Complaints about the service (e.g. breakfast did not arrive) — go to the Seller. Technical issues with the Portal — go to Hostante.
  • Seller / Provider — Renters spółka z ograniczoną odpowiedzialnością (Renters sp. z o.o.), trading as HeyRent,, registered office at ul. Jana Sebastiana Bacha 26A, 02-743 Warszawa, Polska, entered in the Polish Register of Entrepreneurs (KRS) under no. 0000678215, NIP 5213782041, REGON 367317066. The Seller is the party to contracts concluded with the Guest for Additional Services through the Portal.
  • Portal Operator — Hostante, the brand operated by The Break spółka z ograniczoną odpowiedzialnością (The Break sp. z o.o.), registered office at ul. Rogatkowa 49D, 04-773 Warszawa, Polska, KRS 0000770003, NIP 9512477738. The Portal Operator provides the Seller with the Portal as a technical tool (software as a service, art. 750 of the Polish Civil Code) enabling the Seller to present its offer and sell Additional Services to Guests itself. The Portal Operator is not the seller, is not a party to the Additional Services contracts and does not conclude them in the Seller's name — the contract is concluded directly between the Guest and the Seller. The terms of using the Portal itself are set out in the Platform Terms.
  • Guest / Buyer — a person holding an active reservation at a property served by the Seller and using the Portal.
  • Additional Services — the services and products offered to Guests by the Seller through the Portal, described in §3.
  • Payment Operator — Stripe Technology Europe, Limited (STEL) — an Irish e-money institution supervised by the Central Bank of Ireland (ref. C187865), with which the Seller has itself contracted (as the acceptant) and through which the Seller accepts payments for Additional Services directly into its own Stripe account (a connected account). Guest funds flow directly to the Seller; the Portal Operator does not collect, hold or settle Guest funds, operates no account to pool them, and provides no payment service within the meaning of the Polish Payment Services Act of 19 August 2011. The transaction-handling fee is charged by the payment operator directly to the Seller.

Acceptance of these Terms is voluntary but required to place an order. The Terms are provided free of charge in a form that can be saved and reproduced.

§3. Offer — Additional Services and prices

Through the Portal the Guest may purchase from the Seller the following stay-related Additional Services:

  • Breakfast — a meal delivered to the property the next morning (catering service for a specified date);
  • Stay protection (waiver) — a one-off contractual clause releasing the Guest from the obligation to cover the cost of minor damage to the property during the stay, up to 500 PLN. Exclusions: damage caused by the Guest’s wilful misconduct or gross negligence, theft and loss of movable property in excess of the limit, the Guest’s personal belongings, damage wilfully caused to third parties. Stay protection replaces the refundable deposit and is activated immediately upon payment;
  • Refundable deposit — an amount held / charged to the Guest’s card at the time of payment; a hold is released, and a charge is refunded in full, after check-out if no damage occurred. The deposit is held or captured at the time of payment, depending on the length of the stay. A hold is released, and a capture is refunded, entirely by the Seller via the Seller's own payment system (on the Seller's account), within 14 days after check-out;
  • Early check-in / late check-out / stay extension — services performed after Seller approval and subject to availability;
  • Pet fee, baby crib, housekeeping tip — other services and amenities.

Each item is described together with its price. All prices are in Polish złoty (PLN) and are gross. The price shown at the time of ordering is binding. The Seller performs the Additional Services directly or through cooperating subcontractors. The Seller uses the Portal as a technical tool to present its offer and sell Additional Services itself; the contract is concluded directly between the Seller and the Guest.

For making the Portal available, the Portal Operator is entitled to a commission from the Seller — remuneration for a service supplied electronically (art. 750 of the Polish Civil Code), plus VAT at 23%. The net commission amount is automatically deducted by Stripe Technology Europe, Limited (STEL) — an Irish e-money institution supervised by the Central Bank of Ireland (ref. C187865) from the amount settled to the Seller, as part of the same transaction settlement (a platform fee collected by Stripe, i.e. an application fee) — the Portal Operator does not receive this amount directly from the Seller. The VAT due on the commission is settled separately, via a VAT invoice issued to the Seller by the Portal Operator (separately for each Seller entity). The commission is not deducted from Guest funds (the Portal Operator never holds them, nor does it charge the Stripe transaction fee, which the Seller bears directly). The Portal Operator’s commission is not borne by the Guest — the price shown to the Guest is the final price; the commission is settled solely between the Seller and the Portal Operator.

The Seller alone is entitled and obliged to issue sales documents (fiscal receipt, VAT invoice) to the Guest — in accordance with applicable laws (including the Polish National e-Invoice System, KSeF). The sales document is issued under the NIP of the Seller relevant to the given reservation, via the Seller's own systems. The Portal Operator does not issue sales documents to the Guest — it provides only an order confirmation and a payment confirmation, which are neither sales invoices nor fiscal receipts. Requests for a VAT invoice should be addressed to the Seller under the Seller’s procedure.

§4. Placing an order and concluding the contract

  1. The Guest selects Additional Services, which are added to the cart.
  2. Before ordering, the Guest reviews and accepts the Seller’s Terms, the Platform Terms, and both privacy policies (Seller’s and Platform’s) in the order form.
  3. The order is placed by clicking the “Order and pay” button, which clearly indicates the obligation to pay.
  4. Payment is made directly to the Seller through the Seller’s own Stripe account (a connected account managed by Stripe Technology Europe, Limited (STEL) — an Irish e-money institution supervised by the Central Bank of Ireland (ref. C187865)); available payment methods depend on the Seller’s account configuration and are shown at checkout. Guest funds for Additional Services flow directly to the Seller. The Break sp. z o.o. is not a party to the Sales Contract concluded between the Guest and the Seller and does not intermediate the payment — that contract is concluded directly between the Seller and the Guest upon successful payment (for services requiring approval — upon Seller confirmation and payment).
  5. An order confirmation is sent to the Guest’s e-mail address.

§5. Method and time of performance

  • Breakfast — delivered to the property the next morning, 08:00–10:00 (unless stated otherwise for the property).
  • Stay protection (waiver) — activated immediately after payment is recorded.
  • Refundable deposit — held or charged to the Guest’s card at the time of payment; a hold is released, and a charge is refunded in full, after check-out if no damage occurred.
  • Early check-in / late check-out / stay extension — performed on the arrival or departure day; charged only after Seller approval.
  • Other amenities (pet, crib) — provided during the stay.

The average fulfilment time is up to 24 hours, and the maximum fulfilment time does not exceed the Guest’s stay at the property.

§6. Withdrawal and refunds

Below we indicate for which Additional Services the 14-day right of withdrawal applies and for which it is excluded by law.

A consumer generally has the right to withdraw from a distance contract within 14 days without giving a reason. Due to the nature of the Additional Services, this right is subject to the statutory exceptions in Art. 38 of the Polish Consumer Rights Act:

  • Breakfast — as a catering service for a specified day, it is not subject to the right of withdrawal (Art. 38(1)(12)).
  • Early check-in, late check-out, stay extension — as accommodation-related services for a specified day or period, they are not subject to the right of withdrawal (Art. 38(1)(12)).
  • Stay protection (waiver) — a one-off contractual clause releasing the Guest from the obligation to cover the cost of minor damage to the property during the stay, within the limits set out in §3; it does not constitute an insurance contract within the meaning of the Polish Insurance and Reinsurance Activity Act of 11 September 2015 and is not an insurance product. The service is fully performed upon its activation (i.e. once payment is recorded) — from that moment, at the Guest’s request, performance begins before the 14-day withdrawal period expires, and once performance is complete the Guest loses the right of withdrawal under Art. 38(1)(1) of the Polish Consumer Rights Act. By placing the order, the Guest expressly consents to performance beginning before the withdrawal period expires and acknowledges that, once the service is fully performed, the right of withdrawal will be lost.
  • Pet fee and baby crib — retain the statutory 14-day right of withdrawal; in practice they can be cancelled until the check-in date (see the cancellation policy below).
  • Tip — a voluntary payment; once the tip has been transferred to staff, refund is not feasible on objective grounds. Complaints concerning an incorrect tip amount are handled under §7.

Regardless of the statutory exceptions above, the Seller applies the following cancellation and refund policy (voluntarily, in the Guest’s favour):

  • Breakfast — free cancellation until 18:00 the day before delivery; thereafter non-refundable.
  • Pet fee and crib — cancellable until the check-in date.
  • Early check-in / check-out / extension — if the Seller does not approve the request, no charge is made; approved and paid services are non-refundable unless force majeure occurs or the Seller fails to perform for reasons attributable to it — in such cases the Guest is entitled to a full refund.
  • Refundable deposit — a hold is released, and a charge is refunded in full, after check-out if the Seller does not report damage during the stay. The release of the hold, or the refund of the charged amount, is executed by the Seller via the Seller's own payment system (on the Seller's account), within 14 days after check-out.

Refunds are executed by the Seller via its own Stripe account (a connected account, in which the Seller is the acceptant, managed by Stripe Technology Europe, Limited (STEL) — an Irish e-money institution supervised by the Central Bank of Ireland (ref. C187865)) — the Portal Operator may only technically initiate a refund within the Seller’s payment system and on the Seller’s account, without ever holding the funds. On withdrawal, the refund is made promptly and no later than within 14 days of receipt of the withdrawal statement (Art. 32 of the Polish Consumer Rights Act). Refund requests and questions: hey@heyrent.com or by post: ul. Jana Sebastiana Bacha 26A, 02-743 Warszawa, Polska. Given the service nature of the offer, postal returns of goods generally do not apply.

§7. Complaints

The Seller must provide the Additional Services free of defects. Complaints split into two paths depending on what they concern:

(A) Complaints concerning Additional Services (performance of the Contract by the Seller — e.g. breakfast did not arrive, early check-in was not arranged, stay protection settlement is disputed):

  • should be addressed directly to the Seller — by e-mail to hey@heyrent.com or in writing to the Seller’s registered office: ul. Jana Sebastiana Bacha 26A, 02-743 Warszawa, Polska;
  • the complaint should include the Guest’s details, reservation number, a description of the issue and the expected resolution;
  • the Seller handles the complaint within 14 days of receipt and informs the Guest of the outcome; pursuant to Art. 7a of the Polish Consumer Rights Act, failure to respond within this period constitutes acceptance of the complaint;
  • the consumer-Guest selects the manner of resolving the complaint under the Polish Civil Code (in particular Art. 471 et seq. and Art. 750) — including replacement with a defect-free service, re-performance, price reduction, or — in cases specified by the act — withdrawal from the contract with a refund of the price.

(B) Complaints concerning the operation of the Portal (e.g. technical errors of the Portal, unavailability): are addressed to the Portal Operator. Complaints concerning the payment itself (e.g. double card charges, a missing refund) relate to payment handling on the Seller's side and its payment operator — they are addressed to the Seller:

  • should be addressed to the Portal Operator at contact@breakmake.pl;
  • the Portal Operator handles the complaint within 14 days of receipt and informs the Guest of the outcome.

Complaints concerning the stay itself at the property (property condition, check-in, access to the property, operation of locks and entry codes) are not governed by these Terms and should be addressed under the reservation contract concluded via the booking platform.

A consumer may use out-of-court dispute resolution (art. 12(1)(21) of the Polish Consumer Rights Act) — in particular by contacting the Provincial Inspector of Trade Inspection competent for the Seller’s registered office or the district (municipal) consumer ombudsman. Detailed information on out-of-court consumer dispute resolution is available on the website of the Office of Competition and Consumer Protection (UOKiK): uokik.gov.pl.

§8. Order limitations

  • the Portal may be used only by Guests holding an active reservation at a property served by the Seller;
  • services are performed only within the territory of the Republic of Poland;
  • approval-based services (early check-in, late check-out, stay extension) depend on the Seller’s decision and availability, including the property’s calendar availability;
  • the Seller may refuse an order that breaches these Terms or the law.

§9. Personal data

The controller of the Guest’s personal data in connection with the Additional Services contract and its performance is the Seller — see the Seller’s Privacy Policy.

For matters concerning use of the Portal itself (session, authentication, analytics, support) the data controller is the Portal Operator — see the Platform Privacy Policy.

§10. Final provisions

  • Matters not regulated herein are governed by Polish law. The Polish-language version of these Terms is the governing text; the English version is provided as a courtesy translation only — in the event of any discrepancy, the Polish version prevails.
  • The Seller may amend these Terms for valid reasons, in particular: (a) changes in generally applicable laws; (b) changes in the scope or method of providing Additional Services that materially affect how the Portal is used; (c) a change of the payment operator or Portal infrastructure provider — required by a decision of that operator or provider, a supervisory authority or applicable law; (d) a requirement of a court, supervisory authority or the President of UOKiK. Amendments are announced at least 14 days in advance on the Portal and, where possible, by e-mail; orders placed before the amendment takes effect are governed by the Terms in force at the time of ordering.
  • These Terms are effective from 28.05.2026.
